High Court Upholds Betfair Case Against WA Laws
Australia's High Court yesterday struck down the anti-betting exchange laws enacted by the Western Australian government in 2006. The laws operated to prevent people in WA from using a licensed betting exchange & a betting exchange from offering markets on WA races. The Court declared the laws contravened section 92 of the Commonwealth Constitution (which guarantees "free trade" across State boundaries). Betfair chief executive Anthony Klok commented: "We're very pleased with the result & we're sure our customers will be delighted. Apart from the lifting of an unfair commercial restraint on our business, it opens the door for us to establish a formal relationship with the WA racing industry."
