Court Overturns Nikolic Ban

Danny Nikolic is a step closer to resuming his riding career after the Supreme Court yesterday overturned the ban preventing him from attending Victorian racetracks, reports The Age. The controversial jockey applied for a judicial review of the decision made in November last year by Victorian Police to ban him from the State's racetracks. Justice Ginnane found in favour of Nikolic ruling that the imposition of the ban was unlawful. "The exclusion order that was made against Mr Nikolic was not made in accordance with law, in that Mr Nikolic was not provided with the details against him," Justice Ginnane said. His Honour said Nikolic was not provided with specific details of the allegations against him and, therefore, the right to defend himself. "The exclusion order is, therefore, invalid and of no legal effect," he said. Nikolic will front a directions hearing at the Victorian Civil and Administrative Tribunal today to try and have his licence reinstated.
